3 steps to take to legally change your gender in Georgia

We at The Law Office of Gina Smalley, are proud to assist our clients on their journey of self-identification. To assist with the process of legally changing your gender, we have broken down the process into three steps.

Step 1: Legally change your name
To legally change your name, you will need to complete and file a Name Change petition with the Superior Court in the county you live in.
You will need the following items to complete the Name Change petition
A current valid Georgia driver’s license (before gender change)
A Petition to Change Name form, a Verification form, and a Notice of Petition. Your local Clerk’s Office will provide these forms depending on their individual requirements.

Step 2: Amend your birth certificate
After legally changing your name, you’re now able to amend your birth certificate. To amend your birth certificate you will need to provide the following item to the Georgia Office of Vital Records:
Proof of a legal name change
A court order proving you have undergone a surgical procedure in changing your sex. (We can assist you with obtaining the court order.)

Step 3: Get a new Driver’s License/ID
Once you have completed Steps 1-2, you’re ready to obtain a Georgia license/ID with your corrected gender. The Department of Driver Services will ask you for the following items:
A court order (or a doctor’s note) stating your name, date of birth, and date of gender changing procedure. The DDS may or may not accept a doctor’s note, so a court order is preferred, but keep in mind that a court order is public record.
